Terms of Service

1. Acceptance of Terms

By accessing or using AIslands ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AIslands is a web-based platform that allows users to create AI-powered projects ("Islands"), configure custom AI agents, collaborate with AI models using their own API keys, and share their work with a public community feed.

The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

• You must provide a valid email address and choose a username to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years old to use the Service.
• One person may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. User Content

"User Content" refers to all content you create, upload, or store through the Service, including but not limited to: project titles, descriptions, tasks, notes, AI profile configurations, system prompts, and chat messages.

• You retain ownership of all User Content you create.
• By making a project public, you grant AIslands a non-exclusive, royalty-free license to display the project title, your username, and AI profile names on the community feed.
• You may delete your User Content at any time, which will remove it from our systems.
• We do not claim ownership over your AI configurations, system prompts, or chat logs.

5. API Keys & Third-Party Services

• The Service allows you to provide your own API keys from third-party AI providers (OpenAI, Anthropic, DeepSeek, Google Gemini).
• You are solely responsible for the use of your API keys and any charges incurred from the third-party providers.
• AIslands acts as an intermediary, forwarding your requests to your chosen provider. We do not modify, log, or analyze the content of your AI conversations beyond what is necessary to deliver the Service.
• You must comply with the terms of service of any third-party AI provider whose API key you use through AIslands.
• AIslands is not responsible for outages, rate limits, or policy changes enacted by third-party AI providers.

6. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations.
• Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to other users' accounts, data, or projects.
• Use the platform to spam, phish, or distribute malware.
• Circumvent, disable, or interfere with security features of the Service.
• Use automated tools (bots, scrapers) to access the Service without permission.
• Impersonate other users or entities.
• Use AI agents configured on the platform to generate content that violates the acceptable use policies of the underlying AI providers.

7. Public Content & Community Feed

• When you toggle a project to "public," its title, your username, and associated AI profile names become visible to all users on the feed.
• Project descriptions, tasks, notes, full system prompts, and chat logs are not displayed on the public feed.
• You may make a project private again at any time, which removes it from the public feed.

8. Intellectual Property

• The AIslands platform, including its design, code, pixel art, and branding, is owned by AIslands and protected by copyright.
• User-created AI profiles, system prompts, and project content remain the intellectual property of the user who created them.
• Output generated by AI models belongs to you to the extent permitted by the terms of the AI provider whose model generated it.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

• AIslands is not liable for any damages arising from the use or inability to use the Service, including loss of data, loss of profits, or any indirect, incidental, or consequential damages.
• AIslands is not responsible for the accuracy, quality, or legality of content generated by third-party AI models.
• AIslands is not liable for any charges incurred on your third-party AI provider accounts.
• We make reasonable efforts to keep the Service available but do not guarantee uptime or uninterrupted access.

10. Account Termination

• You may delete your account at any time. This permanently removes all your data from our systems.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.
• Upon termination, all User Content associated with the account will be deleted.

11. Changes to Terms

We may revise these Terms from time to time. Updated terms will be posted on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.

For significant changes, we may notify users via email or an in-app announcement.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from the use of the Service shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be submitted to binding arbitration.
